The following terms, conditions and understandings are part of our proposal unless stated otherwise in the proposal. Please read them carefully.
- All equipment, materials, freight, labor and supervision will be furnished; the costs for these items are included in the proposal.
- Payments according to the schedule are due upon completion of each phase of the project (see the corresponding payment schedule).
- Prices estimated by the seller include applicable federal, state or local taxes unless stated otherwise.
- The customer will have the area cleared and ready for our installation crew at the scheduled time.
- Should the project be canceled by the buyer after the proposal has been issued, there will be a 30% charge to cover the cost of cancellation. In addition, if the material has left the manufacturer’s dock, the customer will be responsible for all expenses incurred plus a 20% restocking charge. Any order for a custom color, style or model that has already been manufactured must be paid for in full.
- The proposal is subject to a job site inspection prior to commencement of work. Material changes from the original inspection or the information provided will require a change order prior to commencement of the project.
- Job site interruptions outside the control of Bay Condor SVS, unless otherwise noted, may require a change order for compensation.
- It is Bay Condor SVS’s policy that, prior to starting the project, we must be in receipt of a copy of the proposal and the mobilization fee (down payment). Faxed copies of the proposal are acceptable.
- Change in the work. Should the owner or construction lender direct any modification or addition to the work covered by this contract, the contract price shall be adjusted accordingly. Modifications or additions to the work shall be executed only when a contract change order has been signed by both the owner and the contractor. The change in the contract price caused by such a change order shall be as agreed in writing. If the parties do not agree on the change in contract price, the contractor’s actual cost of all labor, equipment, subcontracts and materials, plus a contractor’s fee of 30%, shall be the change in contract price. The contract change order may also increase the time within which the contract is to be completed.
- Exclusions. Permits, fees, inspections, lead abatement and asbestos abatement are not included.
Proposal validity. Proposals are valid for 15 days. Pricing is subject to change after 15 days.
